However, the item is covered by ERD\u2019S 3-Year Warranty, the terms of which are set forth below.* 1.1 ERD warrants that the components repaired pursuant to a particular repair order (\u201cRepaired Goods\u201d) shall be free from defects in materials and workmanship for a period of three (3) years from the date the customer is invoiced for the Repaired Goods (\u201cthe Warranty Period\u201d).* The foregoing warranty shall only be applicable to Repaired Goods stored, installed, handled, operated, or otherwise used under normal conditions. All warranties issued herein are non-transferable without ERD\u2019s prior written consent. 1.3 If during the Warranty Period, a customer wishes to make a claim under Section 1.1 (\u201cWarranty Claim\u201d), the customer shall provide notice using the following methods: Email: cserv@erdltdinc.com Phone: 336-992-3611 Form: Completion of ERD\u2019s Warranty Form with a detailed description of the nature of the problem. 1.4 Freight and rush fees for goods returned under Warranty Claims shall remain the responsibility of the customer. 1.5 ERD\u2019s obligation shall be limited to the repair or replacement, in ERD\u2019s sole discretion, of any such Repaired Good (or part\/component thereof as ERD determines) free of charge to our customer. If ERD determines that the Repaired Good cannot be repaired or replaced, after three repair attempts ERD shall issue a trade credit towards a future repair.\u00a0 ERD reserves the right to limit any warranty. 1.6 Due to the nature of electronics and circuit board repair, ERD cannot guarantee or warranty circuity and components unrelated to the reported problem. 1.7 Any warranty claim must be received before the end of the Warranty Period, together with return of the Good within this same period. 1.8 Invalidated warranties may be subject to a minimum of 10% of the original repair charges or a 350.00 minimum. 1.9 This warranty is given in lieu of any other warranties, either express or implied, including that ERD disclaims any warranty of merchantability, fitness for a particular purpose and\/or non-infringement. In no event shall ERD be liable for any damages except actual damages up to, but not exceeding, the amount paid to ERD for the Repaired Good. Further, ERD shall not be liable for any special damages including consequential damages, incidental damages, lost profits, or lost revenue. 2.0 Without limitation, ERD\u2019s warranty shall not apply to items that have failed due to operation exceeding the rated capabilities, failure of software, misuse or abuse, tampering, improper installation, improper setup or storage, neglect, contaminant damage, water or other fluid damage, acts of God or Nature or by any other cause not within reasonable control and which by the exercise of reasonable diligence is unable to be prevented. Software ERD DOES NOT WARRANTY ANY APPLICATION SOFTWARE, USER PROGRAMS OR FIRMWARE. UNITS DEEMED INOPERABLE DUE TO CUSTOM APPLICATION(S) AND\/OR FIRMWARE ARE NOT CONSIDERED A WARRANTY. Closed Loop Systems Because of the complexity and interaction of a closed loop system, any system that is not fully verified by ERD at the time of the repair will have limited support. Any warranty claims will be evaluated by ERD to identify components needed to be included for warranty evaluation. Any tuning for a closed loop system will incur additional charges. *Mobile Platform Mobile platforms including construction equipment and vehicles, unless specifically indicated, will have a warranty period of 1 year.
